NRA Files Amicus Brief in PA Supreme Court “Ghost Gun” Case

The case is a challenge to Philadelphia’s prohibition on the private manufacture of firearms.

Yesterday, the National Rifle Association joined an amicus brief, along with the Allegheny County Sportsmen’s League, Firearms Owners Against Crime – Institute for Legal, Legislative, and Educational Action, and Second Amendment Foundation, filed in a “ghost gun” case before the Pennsylvania Supreme Court.

The case, Gun Owners of America v. City of Philadelphia, is a challenge to Philadelphia’s prohibition on the private manufacture of firearms.

The amicus brief argues that any regulation of firearms or ammunition—including their parts and components—by local governments is preempted by Pennsylvania’s Uniform Firearms Act, Pennsylvania’s constitution, and public and legislative reliance.

In addition to protecting Pennsylvanians’ right to privately manufacture arms—a right recognized and exercised since before our nation’s Founding—a favorable decision in this case is likely to positively impact Anderson v. City of Pittsburgh, an NRA-backed preemption challenge to Pittsburgh’s prohibition on magazines that hold over 10 rounds of ammunition.
